Right to Know

The District recognizes the value of making information available to the public and is committed to continually improving public access to public information and fostering public participation in the decision-making process.

The PCCD's Right to Know Policy establishes the District’s procedures for meeting its obligations under the Pennsylvania Right to Know (RTK) Law, which was revised in 2008. It applies to all requests for “public records.”

 

  • What is the Pennsylvania Right to Know Law (RTKL)?
    • The RTKL is a Pennsylvania statute that gives the public the right to access certain records maintained by local and state agencies, including the Pike County Conservation District. It is intended to promote transparency and accountability in government.
  • Who can submit a Right to Know request?
    • Any legal resident of the United States can submit a RTKL request to PCCD. You are not required to state a reason for your request.
  • Do I have to use a specific form?
    • Yes, requests should be made in writing and may be submitted on PCCD’s designated Right to Know request form or the standard Office of Open Records form. Written requests may be mailed, emailed, faxed, or delivered in person.
  • What information must be included in my request?
    • Your RTKL request must:
      • Clearly identify your name and address for the response.
      • State that it is made under the Right to Know Law.
      • Describe the records you want “with sufficient specificity” so PCCD can locate them.
  • Can I make a verbal request?
    • You can ask for records verbally, but only written requests allow you to pursue formal remedies under the Right to Know Law, such as filing an appeal if access is denied.
  • How long does PCCD have to respond?
    • Under the RTKL, PCCD generally must issue an initial response within five (5) business days after receiving your request. In some cases, additional time may be needed, in which case PCCD will notify you in writing.
  • Are there costs or fees?
    • Yes. PCCD may charge reasonable fees for copies, postage, or other necessary costs associated with fulfilling your request. If the estimated fees exceed $100, PCCD may require prepayment before producing records.
  • What if my request is denied?
    • If PCCD denies your request in whole or in part, including a “deemed denial” if no timely response is provided, you may appeal the decision to the Pennsylvania Office of Open Records (OOR) within 15 business days of the denial notice or date of deemed denial.
  • Will my request become public?
    • Yes. RTKL requests received by PCCD and the responses it issues are generally considered public records themselves and may be made available for public access.
  • Can PCCD withhold any records?
    • Some records may be exempt from disclosure under specific provisions of the Right to Know Law. In those cases, PCCD must cite the legal basis for any denial or partial denial of access.
